Neymar, on trial a month before the World Cup: they ask for five years in prison and the Brazilian’s disqualification

The amounts in the signing of Neymar for Barcelona is still under discussion and this has even led to a legal battle and a trial on the subject is days away. Recently, Paulo Nasser, a lawyer for the Brazilian fund DIS, private prosecutor in the case, explained that the operation by the attacker “It really cost 82 million euros and only 17 appeared as an official transfer.”

Nasser offered this Thursday a press conference in Barcelona in which he gave details about the arguments of the accusation before the beginning of the oral trial that will take place in the Sixth Section of the Barcelona Court next Monday.

“Our demand has two bases. The first one is a crime of private corruption. And, the second, a crime of fraud in the contractual simulation modality. The real cause of the contracts that Neymar signed with FC Barcelona was to save what they had to pay to DIS and Santos, a termination clause of 65 million euros.explained the lawyer.

Details of the agreement by Neymar

In 2009, DIS secured 40% of a future transfer of the player, who had not yet made his professional debut at Santos, in exchange for 2 million euros.

But the lawyers of the Brazilian fund consider that this pact was breached.

FC Barcelona ended up disbursing 25.17 million to Santos for the player’s rights and another 60 million for various concepts to N & N Consultoria Esportiva, the family business run by Neymar’s father, but DIS only received 6.8 million, for his 40%.

However, DIS’s attorney considers that “Santos ended up receiving their share of 55%”. “This was done by confidentially agreeing a friendly match with Barcelona for a price of 4.5 million euros and paying 7.9 million for a right of preference for three players that has never been exercised”he added.

They ask for prison for Neymar

For this reason, DIS and FAAP (Associations of Professional Athletes of Brazil), who will appear as private accusations, ask for five years in prison for Neymar, a fine for the benefit of the State of 149 million euros and “a disqualification for his profession as a player” while the sentence lasts.

In addition, they ask for a sentence of five years in prison for Sandro Rosell and Josep Maria Bartomeu (president and vice-president of the Barça club at that time), in addition to seven and a half years of disqualification from holding managerial positions and 195 million in financial compensation for the benefit of the Condition.

For its part, the Public Prosecutor’s Office requests five years in prison and a ten million euro fine for Sandro Rosell for the crimes of corruption in business and fraud in the signing of Neymar, for which he also requests two years in prison and another ten million fine for a crime of corruption in business.
