The Labor Court number 10 of Barcelona has condemned the FC Barcelona to pay 7.7 million euros to the Brazilian soccer player matheus fernandes for having incurred in an unfair dismissal in 2021, when the Barça club terminated the midfielder’s contract.
According to the ‘Què t’hi jugues’ program of SER Cataluña and judicial sources have confirmed to EFE, the footballer must receive, according to the sentence, 7.7 million euros, in addition to the 810,000 euros that the club owed the player corresponding to the salary negotiation agreed in 2020.
The ruling dismisses, on the other hand, the additional 5 million euros that the player claimed for moral and reputational damage.
In the legal foundations, it is established that “regardless of other circumstances (…), which could serve to delimit the two figures of contractual termination, what seems clear is that the consideration of low performance as contractual breach for the purposes of justify the termination of the employment contract, inevitably requires the existence of a comparison element to reach the conclusion of low performance.
Therefore, it could be produced “according to a subjective criterion, taking as a measure that obtained by the worker himself previously, either attending to an objective criterion, referring to the performance marked by other workers who carry out the same activity”.
Matheus Fernandes signed for Barça from Palmeiras in the 2020 winter market in exchange for 8.6 million euros. After confirming his incorporation, he was immediately loaned to Real Valladolid until the end of the course.
In his only campaign (2020-21) in the Barça first team, the Brazilian played only 17 minutes of a Champions League duel against Dinamo kyiv.
On June 29, 2021, Barcelona sent a disciplinary dismissal letter to the footballer, who had a valid contract with the entity until June 2025.
Matheus, 24, is currently on loan from Palmeiras to Brazilian side Bragantino, after also playing on loan at Atlético Paranaense.
