As an undisputed mode of proof to authorities and courts, this legal act can be useful in many areas. It is thus possible to obtain a bailiff’s report for the reception of works, the refusal of a right of visit, an amicable inventory of fixtures, water damage, the reception of defective goods or even a rental not authorized.

If this type of procedure is classic, the sector has recently innovated. In order to assert the role of the profession in the field of proof, the National Chamber of Commissioners of Justice (CNCJ) – Bailiffs section has indeed put online in spring 2020 its official website LegalPro.fr. In particular, it makes it possible to inform Internet users about the various existing findings and to direct them in a few clicks to the judicial officer closest to them.

Observations dedicated to the crisis

This platform is also an opportunity to offer procedures adapted to the specific needs of citizens in this unprecedented period of pandemic. From its launch, LegalProof.fr highlighted the new “report of extension and resumption of activity”. The objective: to reassure companies and their customers by certifying that they have taken the necessary health protection measures. And during the reconfinement during the fall, the profession created a “sound calming report”.

On the basis of a reference drawn up with the Noise Information Center, the bailiff can thus precisely qualify the nuisance in order to place it within the legal framework and allow you to settle your conflict with your neighborhood. Indeed, according to a survey by the Noise Information Center carried out in July 2020, sensitivity to sounds has increased with the development of teleworking. While 83% of French people considered themselves sensitive or very sensitive to noise before the first confinement, 57% said they were more sensitive to the quality of the sound environment than before.
