Switzerland approves in a referendum that all its citizens are potential organ donors

The swiss approved today by referendum a legal reform according to which all citizens will potentially be organ donors when they die, unless they have expressly expressed their opposition to it in life or their relatives oppose it.


The reform of the Swiss Transplant Lawapproved today by 60% of voters, introduces the concept of “presumed consent” and reverses the current situation in the country: until now it was necessary to expressly express the desire to donate organs before dying, and now what must be expressed is opposition to it.

Those who do not want their organs to be donated after death must therefore register in a national registry.

Otherwise, their relatives and closest friends will still be consulted if they want the organs of the deceased to be used in transplants, and if he dies without family or unknown close people, his organs will not be used, in accordance with the legal reform .

The Government and Parliament of Switzerland had already approved this reform on October 1, 2021, arguing that many patients in the country currently lose their lives because the transplant they need does not arrive on time, although opponents of it gathered the necessary signatures to submit it to popular consultation.

Some 450 organ transplants are performed in Switzerland each year, but it is estimated that some 1,400 patients are still on the waiting list for this type of intervention, and that one or two die every week because they cannot be carried out on time, due to the shortage of donors.

The promoters of the referendum, and of the no to the legal reform, argued that many patients will be unaware of the new need to express their opposition to organ donation, so that their “right to self-determination and physical integrity” could be violated after his death.

The consultation has had a 40% participation, the highest rate in the three national referendums proposed today in the country.

In the other two, the Swiss approved a tax for streaming platforms to contribute to national film and television production, and also agreed to Switzerland increasing its financial contribution to Frontex, the EU’s border security agency.
