Legally aborts an 11-year-old girl victim of rape who was pressured by a judge to continue with the pregnancy

The 11-year-old girl who became pregnant as a result of rape in Brazil managed to abort in a public hospital in the country, after weeks of indecision due to the refusal of a judge to authorize the procedure, which is protected by law for this type of case.

The case came to light this week after The Intercept Brasil portal disclosed the content of the hearing in which Judge Joana Ribeiro, with the support of the regional prosecutor Mirela Dutra, pressured the girl to have the baby and give it up for adoption.

“Would you take a little longer?” Ribeiro asked the girl.who was then more than 20 weeks pregnant, at that hearing held last May, according to The Intercept Brasil.

The judge argued that giving the green light to an abortion at that stage of pregnancy would be a “homicide”, despite the fact that the victim had the right to it, and also determined the entry of the girl in a foster home to prevent her from doing so.

In Brazil, abortion is currently only allowed in cases of risk to the mother, rape, or fetuses with anencephaly.

The matter ended up in the hands of Justice after the aforementioned hospital in Florianopolis refused to interrupt the minor’s pregnancy at first because it contravened its internal protocols.

Nevertheless, The Federal Public Ministry recommended the day before to the hospital that it comply with the law and interrupt the pregnancy of the minor, she was close to entering the 29th week of gestation.

The body stated in a note that “legal abortion does not need judicial authorization or police communication, nor are there limits in the legislation related to the gestation period and fetal weight for carrying out the procedure.”

The case of this 11-year-old girl had a great impact on social networks and was commented on by some politicians, such as deputy Eduardo Bolsonaro, son of Brazilian President Jair Bolsonaro, and who came out in defense of the judge who rejected the abortion of the minor.

“The SC (Santa Catarina) judge is right” because “the baby could be given up for adoption, something much more civilized than sentencing him to death without being guilty of anything,” said Eduardo Bolsonaro, who, like his father, defends “Life from the moment of conception”.
