The final showdown is on. On Thursday, at the very end of what should be its final public hearing, the House Investigative Committee into the Jan. 6, 2021, Capitol Storming voted to subpoena Donald Trump. The nine elected officials – seven Democrats and two Republicans – voted unanimously for this nuclear option, which should give rise to an unprecedented legal battle, less than a month from the midterms (mid-term elections).

Legal battle ahead
Donald Trump “is the person at the center of the story of what happened on January 6th. So we want to hear it, ”insisted the leader of this panel, Bennie Thompson. Just before, his assistant and pet peeve of the former president, Liz Cheney, had just indicated that the committee had enough elements to recommend criminal charges against several people. But, she explained, about thirty relatives of Donald Trump refused to answer their questions. The committee therefore uses its power of “subpoena” to force the ex-president’s hand.
Donald Trump is unlikely to accept, and a refusal would have to be adjudicated by the courts. Last year, the Justice Department indicted Steve Bannon for “obstructing” the investigation into the Capitol violence. A jury found him guilty in a snap trial this summer, and Donald Trump’s former adviser is expected to be sentenced on Oct. 21. He faces between two months and two years in prison, and up to $200,000 in fines.
