Inter-American Court declares Nicaragua in contempt and sends case to the OAS

The Inter-American Court of Human Rights (IDH Court) declared this Tuesday to Nicaragua in “permanent contempt” to the numerous orders to release imprisoned opponents and will raise the situation to the General Assembly of the Organization of American States (OAS).

“There is a prolonged contempt on the part of the State that places the beneficiaries of the provisional measures in an increasingly vulnerable situation and implies an increase in the risk situation”indicated the Inter-American Court in a resolution published this Tuesday.

The text adds that the Inter-American Court “shall submit to the consideration of the General Assembly of the Organization of American States Nicaragua’s contempt of its decisions.”

The Inter-American Court explained that the State of Nicaragua has expressed its non-acceptance and rejection of the provisional measures adopted in favor of 75 imprisoned opponents of the Government, resolutions that have dates of June 24, September 9, November 4 and 22, 2021, as well as May 25 and October 4, 2022.

In these resolutions, the Inter-American Court has ordered the immediate release of imprisoned opponents, including former presidential candidates, journalists, social leaders, businessmen, students, among others.

Among the beneficiaries of the measures are Juan Sebastián Chamorro, Osé Adán Aguerri Chamorro, Félix Alejandro Maradiaga Blandón, Violeta Mercedes Granera Padilla,. Daisy Tamara Dávila Rivas, Lesther Lenin Alemán Alfaro, Freddy Alberto Navas López and Cristiana María Chamorro Barrios.

“This Court concludes that the manifestation of non-acceptance and rejection by the State of the provisional measures adopted by this Court, the prolongation of the detention of the beneficiaries of the provisional measures, keeps people in a state of absolute vulnerability.” points out the Inter-American Court.

In addition, the Inter-American Court determined that “The arrest of the beneficiaries of the provisional measures, as well as the criminal proceedings against all of them, show a process of harassment and criminalization of people who identify themselves as being in opposition to the current Nicaraguan government.” of President Daniel Ortega.

The resolution indicates that the contempt of the State and the poor conditions of detention of the prisoners suppose “a serious risk of suffering irreparable damage to their rights to life, integrity, health and food.”

The resolution confirms that the Nicaraguan authorities have not facilitated periodic contact of the prisoners with relatives and lawyers and they have not been guaranteed access to health services and medicines, nor to adequate food.

The Inter-American Court revealed that Nicaragua has sent 19 communications in which it has expressed its rejection of the provisional measures “for considering that they follow a script imposed by the United States of America” ​​and “include a biased narrative.”

In April 2018, thousands of Nicaraguans took to the streets to protest controversial social security reforms, which later turned into a demand for Ortega’s resignation as he responded with force.

The protests left at least 355 dead according to the IACHR, although local organizations raise the figure to 684 and the Government recognizes 200.
