Former US President donald trump will sit on the bench in April in New York accused of defamation by a journalist who accuses him of having raped her in the 1990s, according to a decision by the examining magistrate released Tuesday.
Writer and former columnist for Elle magazine, E.Jean Carroll78, sued Trump in November 2019 for defamation after he called a “total lie” in June of that year, the journalist’s allegations that the former president had raped her in a changing room at a shopping center New Yorker in 1995 or 1996.
Both testified in October under oath before the New York investigating judge in the case, Lewis Kaplan.
According to a court document, the judge on Tuesday signed an order setting April 10, 2023, for the start of the trial.
The then Republican president (2017-2021), who in 2019 was protected by head of state immunity, replied that he did not know Carroll and that he was not “its type” of woman.
On the accusations of rape, Carroll had not been able to file a complaint in 2019 since the facts had prescribed.
But on November 24, a new law went into effect in New York State (“Adult Survivors Act”) that allows, for one year, victims of sexual assaults to resort to justice to claim a civil process.
Carroll’s lawyers filed a new lawsuit in New York on Thursday for “defamation” Y “fait accompli” Y “assault”, for which he expects to obtain damages.
According to the lawsuit, “about 27 years ago in the luxury department store Bergdorf Goodman on V Avenue in New York“Donald Trump”grabbed E. Jean Carroll, pushed and pinned her against the wall and raped her”.
It took the plaintiff 20 years to make her story public in a book she published as a result of the #MeToo movement that emerged in 2017 against sexist violence.
Donald Trump’s lawyer Alina Habbasaid Thursday that Carroll’s action “unfortunately constitutes a misuse of the purpose of the law” from New York. In October, Trump called the rape allegations “falsehood and lie”.
