Bolivia: Judge ratifies four months of preventive detention for Luis Fernando Camacho

A judge ratified this Thursday the preventive imprisonment for four months against the governor of the Santa Cruz region, the opposition Luis Fernando Camachoinvestigated for the 2019 crisis in Bolivia.

In a virtual hearing that lasted more than seven hours, Judge Rosmery Pabón considered “inappropriate” the appeals presented by the defense of camachowhich requested the cessation of preventive detention, and also of the accusing entities that demanded the extension of their imprisonment to six months.

Pabón recalled that the Public Ministry has six months to develop the investigative acts in any accusation, but considered that “the exposed elements to determine” preventive detention for four months have “sufficient legal logic.”

He also considered that “the need still exists” about what camacho “Keep the preventive detention”, for which reason he resolved to confirm the provisions of Judge Sergio Pacheco in the precautionary hearing on December 29, one day after the arrest of the governor of Santa Cruz.

During this day’s hearing, the representatives of the Prosecutor’s Office, the Ministry of the Interior (Interior) and the State Attorney General’s Office, who are some of the accusers in the case called “coup d’état I” for which Camacho was arrested, They presented their arguments to request that the preventive detention be extended for six months.

While the governor’s defense reiterated his complaints of violations of his rights and insisted that the resolution that ordered his preventive imprisonment lacked foundation and is an exact copy of the prosecution’s accusation against the opponent.

The governor had a couple of minutes to speak during the hearing, in which at times there were tensions between the defense lawyers and the institutions that accused him, in addition to some interruptions from people outside the process who expressed support and insults towards camacho.

In his speech, camacho He denied that he could influence the investigation of the case by taking advantage of his capacity as regional governor, as denounced by his accusers.

The argument of the Government and the Prosecutor’s Office for the arrest of the opponent is that he did not want to appear to testify at the time, to which the opponent maintained that the times he was notified to give his statement, there were suspensions for different reasons and not because he himself I would want it.

Camacho was arrested on December 28 and is preventively imprisoned in a maximum security prison in the highlands of La Paz as part of the investigations into the “coup d’état I” case related to the 2019 crisis.

The ruling party points out that in 2019 there was a “coup” against then President Evo Morales, while the opposition maintains that the protests that led to his resignation were due to fraud in his favor in the annulled elections of that year.
