I/A Court HR condemns the State of Bolivia for acts of torture against 26 people

The Inter-American Court of Human Rights (IDH Court) condemned this Wednesday the State of bolivian for acts of torture and mistreatment by police officers against 26 people who were detained in the framework of a series of illegal nocturnal raids.

The sentence, notified to the parties this Wednesday, declares the Bolivian State as internationally responsible for the violations of various rights and other harassment committed by police agents in the context of the raids and illegal arrests carried out as part of an operation to capture the suspects of a robbery of a van carrying valuables in December 2001.

The State is responsible for the violation of the rights to personal liberty, private life, home, protection of the family, the right to property, personal integrity, the right of women to live free of violence , the rights of children, the right to life, health, judicial guarantees, judicial protection, honor and dignity, as well as the duty to investigate acts of torture and violence against women”, quotes the sentence.

The Inter-American Court indicated that the nocturnal raids and the arrests carried out during that time were “contrary to the constitutional regulations in force at the time of the facts, and that, due to the use of excessive force, implied a violation of the Convention”.

During the nighttime raids, the rights of the children and adolescents present were disproportionately affected, as well as the right to family life. Likewise, the women were victims of sexual torture during their detentions.”, explains the Court in the document.

According to the International Tribunal, despite the fact that the torture and humiliation were denounced by the legal defense of the victims in several internal instances, they were not the object of a diligent investigation. Therefore, it was also considered that the State of Bolivia violated its duty to investigate acts of torture and violence against women.

It was also determined that several of the victims were exhibited to the press as perpetrators of the robbery of the truck when they had not even been the subject of a formal accusation, for which reason it was considered that the principle of innocence was affected.”, indicates the sentence.

Due to these violations, the Court ordered various measures of reparation from the State, including a review of the conviction of the victims, the establishment of protocols for carrying out searches and other acts of judicial investigation where minors are present. and the payment of compensation amounts to the victims.

The Inter-American Court, based in Costa Rica, is part of the Organization of American States (OAS), and its resolutions are mandatory compliance for the countries of the hemisphere that have recognized its jurisprudence.
