Justice opposes Bolsonaro and allows dismissal of unvaccinated employees

Judge Luis Barroso, of the Supreme Court of Brazil, suspended this Friday all the effects of a regulation issued by the Government of Jair Bolsonaro that prevented companies from firing employees who have not been vaccinated against covid-19.

According to these regulations, requiring vaccination is a “discriminatory practice” equivalent to others related to race, age, sex or deficiencies, and could not be grounds for dismissal, even more so when the Government has not implemented the mandatory nature of immunization.

However, according to the precautionary decision of Judge Barroso, an unvaccinated person “can be a threat to the health of other workers”, represent “risks to the work environment and compromise the health of people who interact with companies.”

In his decision, the magistrate pointed out that “the country and the world are facing a pandemic of serious proportions” and that “covid-19 has been highly contagious and is responsible, in Brazil, for an impressive figure that exceeds 600,000 deaths” .

In this context, he stressed that previous decisions of the Supreme Court have already established that “individual rights must yield to the interest of the community as a whole, in the sense of protecting the right to life and health.”

The Ministry of Labor, responsible for the regulations, announced that it intends to appeal to the plenary session of the Supreme Court, claiming that those citizens who have not wanted to be vaccinated against the coronavirus “cannot be treated by the rest of society as a kind of ‘lepers’ , who cannot coexist in work environments ”.

President Bolsonaro, the leader of a far-right denier, is one of the most skeptical leaders of the severity of covid-19, which he has come to label as “little flu”, and has also shown enormous distrust in vaccines.

Recently, Bolsonaro went to the extreme of assuring that those people who have taken two doses of a vaccine now face a greater risk of contracting AIDS, a statement that unleashed a wave of indignation and was denied by all the medical and scientific associations of the country.
