The Administrative Justice made a decision: The State Council approves the salary cap for temporary doctors in a decision made public on Thursday. From April 3, in accordance with the so-called “Rist” law of April 26, 2021, the maximum amount is 1390 euros gross for 24-hour care.

The National Union of Hospital Substitute Physicians, which opposes any restrictions in the name of the freedom of medical practitioners, has filed an appeal against this entry into force. In particular, he denounced “blind legislation because no study of its impact has been carried out” as well as “its disastrous consequences for the functioning of hospitals”. But that’s why he did not win his case at the hearing, which took place on Tuesday, May 2.

“The Judge of Urgent Applications considers that none of the remedies proposed by the National Union of Hospital Substitute Physicians is of such a nature as to cast serious doubt on the legality of the contested ministerial instruction,” the decision reads. .

Minister of Health and emergency doctor François Braun suggests that he wants to fight the “cannibalistic time period” with a reward that could, in rare cases, rise to 4,000 euros gross. But with those rates locked down, some hospitals, already struggling, are struggling to keep all of their staff accustomed to working from home. This situation has led to partial or complete closure of services, especially emergency departments. François Braun prefers to argue that “dry closure” does not exist, citing the fact that every patient is systematically offered an alternative solution.

Some ER doctors fear that May and June will be even more “busy” than April, when hospital management often found alternative solutions (extension of previous contracts, better contracts for “reason 2”, temporary workers agreeing to stay for a few days) . weeks at a fixed rate, etc.).
