Social security: Employer control over sick leave condemned by main GP union

A measure of “social destruction” that needs to be “removed.” The first general practitioners’ union, MG France, spoke out on Saturday against employer control of sick leave through an authorized doctor, envisaged in the next social security budget. The union “warns parliamentarians of the dangers contained in this provision that must be addressed,” he said in a press release.

The government, which introduced its annual Social Security Financing Bill (PLFSS) this week, included several measures aimed at limiting the rise in sick leave costs. Among these, the provision will give the employer the right to appoint a doctor to review the validity of sick leave, the latter being granted by the attending physician of the employee concerned.

Payment of compensation has been suspended

The possibility of re-examination is not new, but it will now have more serious consequences: if the doctor referred by the employer considers the stop to be unjustified, payment of compensation may be suspended. “If the fight against fraud is necessary, then social destruction is unacceptable,” MG France said.

Of course, the provision provides for the possibility of an appeal, but this will not be “immediate,” the union believes. “The administrative delays and difficulties that some of our patients face in mobilizing them will deprive the most vulnerable of them of their daily benefits,” estimates MG France.

The union calls on all treating doctors to provide their patients with a letter of protest, which may be needed if this measure is applied.
