Budget 2023: MPs Nupes and LR seized the Constitutional Council

They believe that the bill “clearly contradicts a number of provisions and principles of constitutional or organic significance.” The Nupes deputies withdrew from the alliance, on the one hand, in a letter sent by Mathilde Panot (LFI), Boris Vallot (socialists), Cyriel Chatelain (environmentalists) and André Chassin (democratic and republican left group), as well as deputies Republicans on the other hand , each filed an appeal with the Constitutional Council on Monday. They target the state budget for 2023, finally adopted by parliament on Saturday after using 49.3 ten times.

Among the many grievances, deputies from the left and right accuse the government of activating the procedure provided for in Article 49.3 of the Constitution, allowing the adoption of a text without a vote, except for a vote of no confidence.

In the fall, Elizabeth Bourne used it dozens of times, running it for every part of the budget, final text, first and second readings. If the majority of deputies did not denounce the government, the LR and Nupes parliamentarians who seized the Wise Men believe that Elizabeth Bourne could only use 49.3 throughout the text, and not in parts.

Attack on the right to amend parliamentarians

Similarly, they criticize the government for violating the parliamentarians’ right to amend by introducing the text in 49.3 without passing the amendments that the majority of MPs nevertheless voted for. The budget was considered final after the rejection of a vote of no confidence by the LFI group.

Among its flagship measures are a tariff shield to keep energy prices down to 15%, higher teachers’ salaries, and a priority for sovereign ministries. The debate centered on calls from the left and the RN to tax the “excess profits” of large companies such as the oil company Total or shipowner CMA CGM.

MPs from Nupes and the far right called for a broad tax. The executive branch opposed the agreement reached at the European level, in particular, with the limitation of the income of electricity producers, which is likely to bring an additional 11 billion dollars.
