TAS: The deadlines for two decisive decisions for the future of Peruvian football | REPORT

The national tournament is over, the national team season is over, but there are still legal issues to be resolved at the Peruvian Football Federation. Two cases are in the decisive stage in the Court of Arbitration for Sport (TAS): the request for the nullity of the last Assembly of Bases (and consequently the postponement of elections of the next board of directors) and the claim of Cienciano against Cusco FC, for the registration of the soccer player Mathías Carpio (who could rethink the issue of relegation) .

In the last week of November, four professional clubs filed a claim with the Court of Arbitration for Sport (TAS) for considering illegitimate the Assembly of Bases of the Peruvian Football Federation, of November 2. The arguments are the illegitimacy of the Statutes on which the aforementioned Assembly was developed and the irregularity in the development of the meeting. Alianza Lima, Melgar, Cristal and Cienciano presented the formal claim that was sent on November 20.

The case has quietly run its course in recent days. On Monday, the same clubs expressed that they will not participate in the election process of the Peruvian Football Federation, scheduled for December 20. This vote, if it takes place, will be with a single list led by the current president Agustín Lozano.

Julius garcia, a lawyer for the four professional opposition clubs to the FPF, explains that these cases could have a final outcome in six months. However, what is being requested is that in the next few days, the CAS resolves precautionary measures regarding both cases.

“The precautionary measure presented against the Peruvian Football Federation should be resolved before December 20. At most we should have the measure on December 17. The request seeks to suspend the presidential election”, Garcia responds.

Next week, for all the aforementioned, will be decisive for the future of Peruvian football. But if the Court agrees to the demand of the clubs, the precautionary measure will prevent the voting on December 20 and we will have to wait for the final resolution, in the middle of next year, to find out how the organization of the FPF is reorganized.

“If the precautionary measure proceeds, it will also be an alarm for FIFA, which will see repeated cases of irregularities and could intervene”Garcia mentions. A FIFA intervention would imply that a Normalizing Committee with representatives of the different Peruvian football entities enters.

More drawbacks in Videna

Beyond this demand before the TAS, there are more pending subjects to be resolved in the FPF. Federation sources assure that their accounts are blocked in some banks of this entity. The reason? The opposition group would have sent notarized letters to financial entities to account for the illegitimacy of Agustín Lozano as president of the Peruvian Football Federation, because the directive is not registered in Public Registries.

In addition, in the TAS there is another lawsuit to be resolved. Cienciano supports his claim for the reduction of points, due to a bad registration of the player Mathías Carpio. This sanction resulted in an additional point for Cusco FC (the rival in that match), which saved the decline due to goal difference to the detriment of Binacional and San Martín University (these two teams have joined the case).

One of the arguments against Cusco FC is that the Chamber of Resolution and Disputes declared Carpio’s registration in Cienciano as regular. However, five days later they themselves annulled the aforementioned resolution.

For this lawsuit, there is also an injunction. San Martín (who descended directly) and Binacional (who lost the relegation playoff to Carlos Stein, who should not see his promotion, gained on the field, threatened either) would stay in First.

“Yes, it is much more forceful. There was a violation here. Cienciano correctly registered Carpio, there is an obvious issue here. The FPF’s own Disciplinary Committee gets tangled up over whether it was well or badly registered, it does not consult with the competent body, which is the Chamber of Resolution and Disputes, this Chamber first agrees with Cienciano and then says that they were wrong. For me it is a very strong case, the errors are more evident than in cases like Alianza Lima ”, Garcia explains.

As has happened in the last twelve months, again the Peruvian Football Federation you will have to wait for resolutions from the TAS to redefine your course. For now, he has lost all the cases: from the demotion of Stein (and the permanence of Alianza Lima) to the annulment of the 2019 Assembly (something similar to the first claim that we consigned in this report).
