The consultancy made up only of women that was behind the victory of Cienciano in the TAS

A group of women has decided to revolutionize the sports industry in Peru. Perhaps few knew who was behind the legal defense of Cienciano before the Court of Arbitration for Sport (TAS). A case that left a resolution in favor of the Cusco club. This was achieved thanks to the presence of Nathaly Montoya, leading lawyer of the imperial team before this international body and member of SPINC.

Nathaly Montaya She is a lawyer and has a master’s degree in Public Management and International Sports Law. He has been in the world of sports for more than 10 years and is now part of SPINC an interesting project integrated only by women.

“SPINC is created this year. What we were looking for was to do a sports consultation for women. We began to provide advice to soccer clubs. As well as companies linked to football. With members from different specialties. In this case my specialty is sports law and public management”, dice Nathaly Montoya.

All of them have decided to change the face of Peruvian sport. An industry that has been fighting to eradicate various prejudices. SPINC wants to show that women are prepared to take on any sporting situation.

“I tell you because of my experience that I have in the sport. I have been in the sports field for about 10 years. It has been a period of some changes. While it is true that you may see more women, there are still some prejudices. So, we decided to change that a little bit and mapped the project to be girls only.”, thus explains the Nathaly Montoya the reasons why he only works with women.

. He says that at first there was a lot of prejudice because there were clubs that could not believe that a woman could defend them in legal instances. Now things have been changing and little by little women are playing an important role in the growth of the sports industry.

“Over the years this has been growing and changing concepts. The same regulations of many federations speak of the presence of women. For example, in the case of soccer there must be one per commission. This gives women more space,” adds Montoya.

The lawyer was able to stay quietly to continue working abroad. However, he saw that Peru had an interesting market that could be exploited. He thought about the things that nowadays have become routine like the subject of the TAS. That motivated him to return to the country.

THE DEFENSE TO SCIENCE

The creation of SPINC had a great response. The first customers began to arrive. One of them was Cienciano. The imperial team sought out the consultancy to see the entire area of ​​its franchises.

“In the case of Cienciano, they hired us this year to see the matter of their franchises. They wanted to license their academies. So we started looking at how other clubs had done it and we realized that most of them had been taken from the internet. A new plan was worked out for Cienciano, in a structured manner, with procedures, contracts and everything. As it is really a franchise manual”, says Dr. Montoya.

On the way there was the problem of the supposed bad registration of Mathias Carpio which was taken to the TAS. SPINC took the case with .

Nathaly Montoya was the lawyer who led the defense of Cienciano in the TAS.

Cienciano claimed before the TAS that he had not committed any fault in the match where they were tied 2-2 against Cusco FC. The imperial team was punished with the loss of that match and with a score of 3-0 against.

“They alleged that the player’s contract (Mathias Carpio) had been made by the administrator of the U that was not ratified. And that the signature was not correct. Cienciano said that the documents were valid and that is why he registered him in the office of passes and transfers without receiving any observation. After receiving the field card, the player was just lined up. Nothing was ever wanted to be infringed”, explains the lawyer.

He also explained that Cienciano’s claim is not an institutional whim. Let us remember that this defeat did not harm the people of Cusco. However, they did it to defend Mathias Carpio who was left without playing since date 9 of Phase 2 of League 1.

“Everyone talks about Cienciano, but the one who also complains is the player. You had a player sit out from date 9 and he couldn’t play any more matches. The claim of Cienciano went for it. The staff had done nothing wrong and, on the other hand, a young man who is just starting his career was affected. It was an institutional issue and because of the player”, complement Montoya.

The lawyer also took time to talk about the Peruvian Federation and the constant processes that are losing in the TAS. She considers that there should be a better selection of work personnel.

“I think there is now a new board of directors. I think that now they must make the best possible selection of the members of the commissions. Those people who are in charge of solving these cases. You have to have the areas with trained people. That is the lack that the FPF now has. That is why we have contrary resolutions, without much support, which in the end are elevated to an international instance where they lose a lot of money”, sentenced.
