The information was confirmed to Efe by Vivas’s defense attorney and member of this NGO, Kelvi Zambrano, who explained that Vivas has been detained since 2017 and has been on parole since 2018, when Maduro ordered the review of the cases of 39 “political actors.” ” imprisoned.

The sentence was ordered by the First Military Court of Caracas, which decided to acquit Vivas on charges of treason against the fatherland and military rebellion, of which he was also accused.

Vivas was pointed out by Maduro to “train” those who crossed cables at the barricades erected in some streets during the 2014 protests, against whom some motorists hit.

Later, he barricaded himself armed in his home and it was not until April 7, 2017 that he was arrested and detained at the headquarters of the Bolivarian National Intelligence Service (Sebin), known as El Helicoide.

“The court considered that General Ángel Vivas was sentenced for the crime of instigation to rebellion and was for the crimes of treason against the fatherland and military rebellion. Leaving him a sentence of seven years and six months,” Zambrano explained about the decision of the military court.

However, he recalled that since “General Vivas has already served more than half of this sentence”, he will complete the rest of the sentence – around two years – under a system of presentation in court, every 30 days.

“We denounce that in Venezuela, based on the case of General Vivas, what is known as the criminal law of the enemy has been institutionalized, which is that people are treated as if they were a danger to the country or enemies of the country. State,” Zambrano pointed out.

The defense recalled that in 2021 the Inter-American Commission on Human Rights granted Vivas and his family precautionary measures, considering that “they are in a serious and urgent situation of risk” to their rights in Venezuela.
