“Instead of taking me home, he took me to his house”Abelseth said. “Once inside, he raped me on the sofa in his living room”he added.

The young woman did not file a complaint at the time and had her daughter, who is now a teenager. “Everyone assumed that [el embarazo] It was from a boyfriend, and I let them believe that.” Abelseth said into the middle.

However, Barnes appeared in his life 5 years later when he found out that the girl could be his.

“When my daughter was 5 years old, she found out about it, and once she found out, she sought custody and wanted to take it from me,” the woman said, explaining that a DNA test almost certainly showed that he was the father.

“They gave him 50/50 custody even though [la niña] It was caused by rape.”lament.

After gaining joint custody of the little girl, Abelseth filed rape charges against Barnes in 2015.

“I figured if I didn’t do it the next day, there was nothing I could do about it.”Abelseth said. “I went to a trauma counselor and he said, ‘No, you’re 30 after you turned 18.'”

Even though the case was open at the Tangipahoa Parish Sheriff’s Office, a detective was never appointed and nothing was ever investigated, he says.

The woman, who is now 32 years old, claims to have had problems gaining ground in the justice system and lost full custody of her daughter due to accusations recorded on her cell phone.

In addition, she pointed out that the man threatened her, pointing out that he has connections in the justice system.

He’s threatened me several times, saying he has connections in the justice system, so I’d better be careful and he can take her away whenever he wants. I didn’t believe him until it happened.”

“When I found out that she was a rape victim, and that this rapist could get full custody, that’s when I stepped in and said something had to be done about it.”said Stacie Triche of the nonprofit organization Save Lives.

“She has been forced to pay her perpetrator”Triche noted. “Forced to pay alimony and legal fees to her rapist and relinquish custody of the child that is the product of the rape. Has no sense.”

The victim’s defense attorneys even asserted that, if the rape claims fail to be proven, the minimum age of consent in Louisiana is 17 years. Abelseth was 16 when she was abused by Barnes.

“It seems pretty straightforward that not only was a crime committed, but as a result of the crime, this person should not have custody of the child,” said Sean Cassidy, an attorney with the Louisiana Foundation Against Sexual Assault, according to a report.
