The Justice of Japan endorsed the prohibition of equal marriage

Three same-sex couples filed a complaint against the Osaka Government because they are against the legislation japanese that forbids them to marry since they consider it to be a “unfair discrimination” and unconstitutional. However, a court in this southern city of the Asian country dismissed the case.

This Monday, the court in question rejected the request of these people and terminated compensation requested one million yen, which is equivalent to 7,400 dollars.

The complainants argued that same-sex marriage should be accepted under the interpretation of Article 24 of the Constitution, which holds that marriage and its maintenance are based solely on “in the mutual consent of both sexes” and in “mutual cooperation with equal rights”.

Instead, the Justice ruled in favor of the Japanese government because the Constitution of this state does not refer to same-sex couples. “There have not been enough discussions among the people of Japan”, they raised. Still, the court recognized that “it may be possible to create a new system” that takes same-sex couples into account.

The complainants, for their part, warned that they plan to appeal the ruling. The three couples had based their lawsuit on the decision of a court in the city of Sapporo, which in March 2021 ruled that Japan’s civil registration law violated constitutional guarantees of equality before the law. In the ruling, they determined that not recognizing same-sex marriage in Japan was unconstitutional.

“From the perspective of individual dignity, it can be said that it is necessary to realize the benefits of same-sex couples are publicly recognized through official recognition,” the court said.

Community Support LGBTQ+ was gradually growing in Japan, although legal protections for this group have yet to advance.

On the other hand, rights advocates had pushed for an equality law to be passed before last year’s Tokyo Olympics, when the whole world had its eyes on Japan. However, this bill was nullified.
