Spain: a judge grants the change of sex to an 8-year-old boy by assessing his “sufficient maturity”

The decision of the magistrate -dated on June 10 in a judicial resolution to which EFE had access- was known this Monday, the same day that the Spanish Government will approve the bill transwhich allows sex change in the registry without a medical or psychological report from the age of 12 under certain conditions and from the age of 16 autonomously.

In his resolution, the magistrate, head of a player in the city of Ourense (northwest of Spain), determines that the minor’s birth certificate be rectified and the indication of sex be modified, which must be “male” and not “female” as it appeared.

This judicial resolution responds to a request from 2021, in which the parents of the child, named Antonio, requested a change in the civil registry.

The magistrate had the opportunity to meet with the minor last March and verified his “sufficient maturity” and his “stable transsexual situation.”

Throughout the judicial document, the judge recounts the situation experienced by Antonio and underlines that he always thought and felt like a manfor which the change of sex was granted in the Civil Registry.

The bill establishes that the change of registered sex can be carried out from the age of 12: between 12 and 14 years, judicial approval will be required; between 14 and 16, the assistance of parents or guardians; and from 16 there will be no limitation.

The law “depathologizes” trans people, so that the will of the person will be the only requirement for change, thus ending medical reports and the need for medical and legal guardianship. It also prohibits conversion therapies.
