The evidence presented by the CFJ point to the possible criminal responsibility of the Venezuelan security forces in the commission of crimes against humanity against perceived victims linked to the political opposition of the Government of Nicolas Maduro.

Universal jurisdiction allows countries to prosecute such crimes regardless of where they were committed and the nationality of the perpetrator or victim.

According to the CFJ, Argentina is an appropriate jurisdiction given its commitment to universal jurisdiction, with a “solid line of precedents”, because the Argentine federal Justice has previously applied the principle of universal jurisdiction.

Among them, he mentioned that in 2010 the Argentine federal Justice began a criminal investigation into alleged crimes against humanity committed in Spain by the Franco regime (1936-1977), which led to an exhumation order by the court that allowed the daughter of a victim to recover the remains of her father, something that the Spanish courts had not achieved.

In 2021, the Argentine federal Justice began an investigation into the alleged genocide committed against the Rohingya community in burma.

Argentina can become a beacon of hope for the many Venezuelan families and victims who have been waiting for justice for years”, said the Senior Program Manager who directs CFJ investigations on Venezuela, Ignacio Jovtisin statements collected by the statement.

The team The docket of CFJ -which gathers evidence of international crimes to trigger the prosecution of their perpetrators- represents in this case the relatives of two victims of indiscriminate violence in Venezuela.

The Venezuelan justice system is failing victims of mass atrocities in their fight for justice”, said The Docket’s Director of Legal Advice, Yasmine Chubin.

That is why we are helping survivors and their families to gather evidence of the crimes committed against them and to find alternative jurisdictions to ensure that the perpetrators of these crimes are held accountable.”, he added.

As CFJ pointed out, since 2014, when these crimes began to take place, the Venezuelan authorities “they have breached” their obligation to launch effective investigations into alleged international crimes – including murder, torture, sexual violence and arbitrary detentions – committed by Venezuelan officials.

The complaint filed by the CFJ is added to the investigation opened in 2021 in the International Criminal Court for alleged crimes against humanity in Venezuela.
