The videos could be seen in porn sites, some of which require payment to access the material.

Upon learning of this situation, many of those affected took legal action in 2020, requesting that the recordings, of which the author is unknown, be investigated on the grounds that their right to privacy had been violated.

“I panicked”

A local judge, Pablo Muñoz Vázquez, shelved the case, prompting an appeal led by the association Mujeres por la Igualdad Burela.

The same judge now confirmed his initial decision not to proceedSince the videos were recorded in a public place, they cannot be considered a crime.

According to court documents, the judge also ruled that “there was no intention to violate the physical or moral resistance” of the women affected.

“I panicked,” said Jenniffer, one of the women filmed during the local festival in 2019, recalling the moment a friend told her that they had met. Uploaded pictures of her to a porn site.

“And then when I saw the video, I cried, I was really embarrassed, not know what to do”.

Like many of those affected, Jenniffer needed therapy. The latest court ruling has added to the pain.

The case has sparked an online campaign. (WOMEN IN EQUALITY BURELA).

“I feel very frustrated,” she said.

“They are basically saying that if someone He records you on the street, publishes it on a porn site and earns money, that’s fine”.

Ana García, from the Bumei association, warns that this case could set a precedent, because it gives impunity to those who make such recordings.

“Just because you are in a public space, that does not mean that film intimate images and then distributing them is not a crime, because it is about fundamental rights ”, said García.

The decision not to pursue the case has sparked protests and an online campaign under the hashtag #JustizaMaruxaina (Justicia Maruxaina).

The case has also entered the political arena with statements from the Minister of Equality, Irene Montero.

“It is sexual violence” against women, said the Minister of Equality. (Getty Images).

“Taking pictures of a woman without their consent and distributing them is sexual violence“, said.

Gender rights have been the subject of fierce debate between the left and the right in Spain in recent years and this is not the first time that a court decision has led to a reaction from women’s groups.

In 2018, the decision of a judge in Pamplona unleashed massive protests when it considered that the attack on a young woman by five men, nicknamed “La Manada”, was sexual abuse instead of rape.

The Supreme Court eventually overturned the verdict and found the men guilty of rape and increased the jail sentences from nine to 15 years.

The women affected by the A Maruxaina case will appeal again in the hope that the case will finally be investigated.
