Israel finds it “surprising” that South Africa calls for the suspension of “military activities” in Gaza

The Israeli legal team described this Friday as “surprising” South Africa’s request to the International Court of Justice (ICJ) to impose Israel precautionary measures that include the “immediate suspension of military activities” in Gaza and guaranteed that this would leave “the other party” in the conflict “free to continue its attacks”.

The lawyer Christopher Staker consider “This request is honestly amazing.” and explained that “a State that is not a party to the conflict submits a request for precautionary measures requiring the unilateral suspension of military operations by a single party to the conflict, leaving the other party free to continue attacks”.

Furthermore, he warned that “the picture that South Africa showed yesterday about the war in Gaza consists of “several individual incidents” that “are not evidence of the intention of the military operation as a whole”, in the rejection of the accusation of “genocide” presented yesterday by the South African team.

“Precautionary measures must have their limits” highlighted the lawyer, highlighting that these tools cannot “requiring that a State refrain from exercising a plausible right of defense” and recalled that Hamas is considered a “terrorist group” in several countries and it is “unquestionable” that its militiamen committed “a large-scale terrorist attack” in Israel.

The lawyer listed that the precautionary measures “would prevent Israel from being able to defend itself”; “will put an end to attempts to rescue the hostages”; It is “They will give Hamas space to preserve its capabilities, allowing it to pose an even greater risk.”

He also urged the ICJ to take into account in its verdict that Israel “is committed to complying with international humanitarian law” and “is taking measures to alleviate the humanitarian situation” in Gaza.

On the other hand, Israel’s co-agent before the ICJ, Gilad Noam, said that this Court does not have “competence” to rule on this provision, and reiterated that the precautionary measures requested by South Africa they would be “unjustified and prejudiced” toward Israel.

Lawyers representing Israel had their turn today to present all their arguments against the crimes listed yesterday by Pretoria, which accused Israel of violating the 1948 Genocide Convention with its offensive in the Gaza Strip.

South Africa also called for precautionary measures, including “an immediate suspension of Israeli military operations in and against Gaza”, to prevent Israel from continuing to “violate” the Genocide Convention, the treaty at the heart of this case.

In almost 100 days of the Israeli war in Gaza, more than 23,400 people have been killed, in addition to almost 8,000 bodies estimated to be under the rubble.

Furthermore, more than 10,000 children died in the Gaza Strip in just over three months of the harsh Israeli military offensive, and thousands more are missing, presumably buried under the rubble, the organization reported today. Save the children.
