Colombia: Justice of the Peace accepts former paramilitary leader Mancuso and will exclusively decide his freedom

O Special Jurisdiction for Peace (JEP) agreed to carry out preferential investigations against Salvatore Mancuso and exclusively define whether freedom will be granted to the former head of the demobilized United Self-Defense Forces of Colombia (AUC), deported last month to Bogotá from United States

O JEP responded to Mancuso’s appeal, who accepted it but only partially, preferentially taking over his cases and ordering that this judge be the one to decide “about the status libertatis of Mr. Salvatore Mancuso Gómez and on provisional transitional benefits”.

The PEC Legal Situation Definition Chamber is the “single authority that must decide on the freedom (status libertatis) of Mr. Salvatore Mancuso Gómez, on the provisional transitional benefits he requests and on the monitoring exercise of the conditionality regime to which he must submit“explained the president of the JEP Appeals Chamber, Patrícia Linares.

This decision is not accepting Salvatore Mancuso In the PEC, this decision had already been adopted in 2023 (…) where it was very clear that this was a special situation for a paramilitary leader who fulfilled a very specific role during the conflict, being basically at the apex of his paramilitary organization and serve as a liaison with the public force in everything that is the conception, execution, planning of the most serious crimes committed in the conflict“, specified the magistrate Rodolfo Arango.

He also estimated: “As for the conduct committed by Mancuso during this period, from 1989 to 2004, they are the exclusive responsibility of the JEP, heading the special subsection of the Definition Room. The Definition Chamber at this point in the process must decide on your freedom”.

Mancuso was deported on February 27 to Colombia in U.S where he served a 15-year sentence for drug trafficking and since then he has been confined to the La Picota Prison in Bogotásince in Colombia he is being investigated for more than 75 thousand crimes, so his deportation to the country, which was suspended for almost four years due to the covid-19 pandemic after having served his sentence in 2020, was expected by his victims .

The PEC first determined that it was Justice and Peace that should resolve Mancuso’s situation and on March 13, a court in this jurisdiction decided to deny freedom to the former paramilitary leader who was appointed by the Colombian president Gustavo Pedroas “peace manager”to intercede with him Gulf Clanheir to the AUC.

However, the JEP, when resolving the appeal filed by Mancuso’s lawyer, attributed the decision on his freedom, although the decisions previously taken by the Justice and Peace in relation to the bills you have outstanding “are firm and valid“, estimated the magistrate.
