The compensation that the consumer seeks to obtain is 5 million dollars -in addition to legal damages-, not including interest and costs.

The multinational company was also warned about having to use a more precise label on its products because the photo of the box of the Pop-Tarts suggests that the fruit filling contains “A greater relative and absolute quantity of strawberries”.

In addition, the citizen of New York points out that Pop-Tarts are made with a synthetic coloring that makes the filling appear “bright red”, putting the quality of the food in question. Kellogg’s.

In a statement to The Post, a Kellogg’s spokesperson said that “the ingredients and labeling of all our Pop-Tart products fully comply with all legal requirements “.

This is the second lawsuit the company faces after Anita Harris, a woman from Illinois, filed a similar one in August.

The citizen alleged at that time that the marketing strategy used by the brand was “Misleading because it gives people the impression that the fruit filling contains a greater relative and absolute amount of strawberries than it does”.

“Several lawsuits have recently claimed that there is no real tuna in Subway’s tuna sandwich, that the Honey Bunches of Oats are almost devoid of honey, and that the Morning Star Farms Veggie Hot Dogs have almost no vegetables. How will those cases end? It’s going to be like tossing a coin “, said Edgar Dworsky, consumer attorney and founder and editor of Consumer World, on the lawsuit.
