Supreme Court of Brazil calls on the Government to respond on vaccination card

The Supreme Court of Brazil gave this Monday a period of 48 hours for the Government of President Jair Bolsonaro to explain its refusal to impose the mandatory nature of the vaccination certificate against covid-19 to passengers coming from abroad.

The ultimatum was imposed by the magistrate Luis Roberto Barroso, one of the eleven members of the Federal Supreme Court (STF) and who must rule on an appeal presented by the Sustainability Network party in which the imposition of this restriction is required as a tool to prevent a further spread of the coronavirus.

The adoption of the restriction is also recommended by the National Health Surveillance Agency (Anvisa), the Public Defender’s Office and the Union Court of Accounts (a consultative body of Congress), especially after the appearance of the omicron, a new variant of the apparently most contagious covid.

In its recommendation to the Government, Anvisa warned that the border policy has to be reviewed and that, in addition to restricting flights from countries where the omicron circulates freely, it is necessary to require the vaccination certificate of those who disembark in Brazil, in addition negative diagnosis for covid.

The ministers responsible for the management of the pandemic had planned to meet this Monday with Anvisa technicians to analyze the measure but canceled the appointment at the last minute without giving explanations.

Despite the recommendations, Bolsonaro affirmed last week that his government does not plan to implement the call “Health passport” because, in his opinion, the “freedom is above all “ and each citizen can decide whether to vaccinate or not.

Faced with the request of the Sustainability Network, the delay of the Government in ruling on the recommendation and the beginning next week of the judicial recess, Judge Barroso established a deadline for the Government to rule on the matter so that he, as an instructor of the process, can give a judgment on the matter.

According to Barroso, the Sustainability Network requested that the obligation be imposed by the Justice “Given the inertia of the Government in reviewing its policy and the imminent risk of dissemination of the new strain when the holiday period and major tourist events (such as carnival) approaches”.

The vaccination certificate is already required in at least 19 regional capitals, such as Sao Paulo and Rio de Janeiro, to access places such as theaters, government buildings or tourist attractions. In Rio de Janeiro it is also necessary to enter hotels, restaurants and bars.

Bolsonaro’s denial in the face of the seriousness of the pandemic led the Supreme Court last week to open a new investigation for a statement in which he linked the covid vaccine with AIDS in vaccinated people.

This is the fifth investigation that Bolsonaro faces in the high court since he assumed power, in January 2019, for various issues, from alleged political interference in the Federal Police to possible irregularities in the negotiations to buy vaccines, through dissemination fake news.
