International Criminal Court considers that there is no basis to open a preliminary examination on repression of protests in Chile

The Prosecutor’s Office of the International Criminal Court (ICC) considers that there is not a sufficient basis to open a preliminary examination to Chile for the police response to the mass protests of October 2019.

“There does not appear to be a basis at this time to open a preliminary examination.”, the ICC Prosecutor’s Office explained today in a statement.

The Hague-based court had received communications alleging that Chilean state forces committed crimes against humanity during protests in Chile beginning in October 2019, in response to an increase in the price of subway fares. in the capital, Santiago.

The denounced events, which according to various NGOs were part of an attack on the civilian population, “do not appear to have occurred in accordance with a State policy to commit such attacks,” said the Prosecutor’s Office.

He also assured that Chile took measures to prevent police abuses, although “with some delay”, and gave as an example that the Government restricted the use of rubber pellet guns in November 2019.

The office headed by Chief Prosecutor Karim Khan positively appreciated “the efforts and measures taken to date at the national level to address the alleged crimes committed” and supported “the continued progress in those efforts to do justice” in the Chilean judicial system.
