Pension reform: decrees on the abolition of major special schemes published in the Official Gazette

The government published on Sunday in the Official Journal executive orders to abolish the main special pension schemes (RATP, electricity and gas, notaries and the Bank of France) provided for by the pension reform. The reform provides for the abolition of these special schemes for agents recruited from September 2023.

Previously hired agents continue to use these schemes (“grandfather clause”), but they are not exempt from the changes provided by the reform for all employees.

Thus, for these agents, “the age of opening the rights is gradually increasing by 2 years” and “the validity period of the insurance required for the full tariff is accelerating,” the Ministry of Labor reminded in the message. “These changes will come into effect on January 1, 2025, when the build-up of measures to converge previous reforms is completed,” he added.

However, the deadlines for canceling the discount in the schemes of the RATP and the electric power industry “remain unchanged,” the ministry reminds.

The Continuing Career Scheme is adapted for these schemes in the same way as for the general scheme, with four age limits for entry into the scheme (16, 18, 20, and 21) allowing early retirement “under the four opening limits law”, at 58, 60, 62 or 63 years respectively.

Certain regimes with “specific subjects” continue to exist

Under the provisions of the reform, “the period of endowment insurance required to benefit from this system has now been reduced to the period required to receive the full rate.” And “the personal commitment of caregivers (in family life: editor’s note) is recognized as the four-quarters granted in this regard can now be taken into account in favor of this device.”

The date of entry into force of the pension reform is September 1, 2023. By that date, the government must publish the bulk of the implementation texts. Certain regimes that respond to “specific restrictions” continue to exist after the reform (sailors, the Paris Opera, the Comédie Francaise). Autonomous regimes (liberal professions and lawyers) are also unaffected.
