Diesel BX for vehicular use returns to the Fuel Price Stabilization Fund

The Ministry of Energy and Mines (Minem) made official this Tuesday the return of Diesel BX for vehicular use to the Fund for the Stabilization of Prices of Fuels Derived from Petroleum (FEPC), as a measure to prevent the high volatility of the prices of the oil and its derivatives is transferred to consumers.

Through Supreme Decree No. 025-2021-EM, published in the El Peruano newspaper, it specifies that the Diesel BX Included in the price range must be intended for the provision of the transport service of people or goods duly authorized by the competent national, regional or local authority, or purchased by direct consumers registered in the Hydrocarbons Registry.

The norm indicates that companies that carry out exploration and exploitation of hydrocarbons and mineral resources, as well as the processing of hydrobiological resources and the manufacture of cement, are excluded from the scope of the law.

Price range

In addition, it mentions that the Import Parity Price (PPI) corresponding to November 8, 2021, with a decrease of S / 0.35 per gallon, will be the upper limit of the Target Price Band.

The update will be made on the last Thursday of each month, as long as the PPI is above the upper limit or below the lower limit. The first change will be made on the last Thursday of January 2022, which, exceptionally, will become effective as of February 1, 2022.

The compensations or discounts generated as a result of the stabilization of the primary sale prices of the Diesel BX intended for vehicular use are applied by producers and importers so that the primary sale price of said combustible remains stabilized, that is, it is not above the corresponding Target Price Band, and according to the location of the primary sale”, Says the decree.

Among the complementary provisions, it establishes that authorized direct consumers must submit to Osinergmin an affidavit stating that they carry out the activity of transporting goods or persons as their main economic activity.

Producers and importers, likewise, must submit to the General Hydrocarbons Directorate a sworn statement of knowledge and compliance with the provisions of the standard.

Meanwhile, direct consumers and retail establishments that allocate this combustible for a different purpose, or who present inaccurate information, will be sanctioned with the suspension of their registration in the Hydrocarbons Registry for a minimum period of 90 days, without prejudice to criminal liability.

This suspension also extends to other agents in the marketing chain who are responsible.
