They admit in Spain a complaint against Gustavo Petro for the kidnapping of a journalist

A judge of the National High Court of Spain admitted for processing a complaint against the candidate for the Presidency of Colombia Gustavo Petro for having joined the armed group “narcoparamilitary M-19″, to which a series of murders and kidnappings are attributed, including that of a journalist who would have Spanish nationality.

In a familiar car this Monday, Judge Joaquin Gadea states that, since the Prosecutor’s Office has opposed the admission of the complaint, “an initial investigation procedure must be agreed, in order to offer the heirs of the kidnapping victim, Fernando Gonzales-Pachecothe possibility of taking criminal action” as plaintiffs.

The magistrate also considers it “important” to “corroborate the Spanish nationality of Fernando Gonzales-Pacheco”, since they attribute him as the place of birth Spain“so it is logical to think that he would hold Spanish nationality of origin”.

And he also sees “essential to confirm, with the competent authorities of the Republic of Colombia, that the accused, Gustavo Francisco Petro Francisco Urregodoes not enjoy the status of amnesty or pardoned, and especially, that he has not been investigated, acquitted or sentenced for the facts that are the subject of this procedure” and also offers the presidential candidate to appear in person at these proceedings.

The Prosecutor’s Office of the National High Court, for its part, which reported against the admission of the defendant, has already appealed the judge’s decision, legal sources informed Efe.

According to the complaint filed in the National High Court on March 18 and collected by the car, Petro, candidate of the left-wing coalition Historical Pact, would have incurred crimes against humanity, war crimes and genocide as a member of the armed group “narco-paramilitary M-19”.

A group, says the letter, that for at least two decades (between the 70s and 80s) “systematically and indiscriminately used the kidnapping of people, as well as torture and murder” to “destroy” the ‘enemy’, among them political opponents, members of the public forces, journalists, businessmen, diplomatic personnel and senior officials of public powers.

Some facts for which, according to the complainant, Petro “has never been called to account before justice” and currently “he would be considered ‘demobilized’ by the group he was part of.”

With all these arguments, observes the judge, “the complainant tries to state that the facts denounced would be in a position to be prosecuted outside of Colombia, since they have not been investigated there, being able to do so since the accused does not hold the status of amnestied or pardoned.”

This, together with the presumed Spanish nationality of one of the victims, would make the National High Court competent to investigate that kidnapping.

However, the judge warns that the crimes that would be “the subject of this investigation would only be prosecuted in Spain after filing a complaint by the aggrieved party or by the Public Prosecutor’s Office.”
