Constitutional Court of Ecuador rejects lawsuits against the dissolution of Parliament

The Constitutional court of Ecuadorthe highest legal control body in the country, rejected on Thursday six unconstitutionality lawsuits filed against the decree issued on Wednesday by the country’s president, the conservative William Lassowhich dissolved the Assembly and called early elections.

The Court, through a statement, specified that the three courts of constitutional judges that analyzed the demands decided “unanimously” reject them, with which the presidential decree, known as “death cross”, remains firm and general elections will be held in about three months.

The court bulletin stated that “the three courts that make up the Admission Room of the Constitutional Court (…) issued six cars“, Through which “decided unanimously to reject the unconstitutionality claims” presented by former legislators.

As a consequence of the decision to reject the unconstitutionality claims, the requests for the Court to adopt precautionary measures in order to provisionally suspend the effects of the challenged decree were also rejected.”, he added.

In the six orders issued, it was emphasized that, “just as the Constitutional Court has no jurisdiction to rule on the verification and motivation of the cause of serious political crisis and internal commotion invoked by the president to dissolve the National Assembly based on article 148 of the Constitution, neither does any other judicial authority in the country”.

At a time when the Legislative Assembly was processing its censorship under the accusation of embezzlement (embezzlement), Lasso applied the “cross death” to dissolve Parliament, advance the general elections and govern until then through executive decrees.

The president, who will celebrate 2 years in power on May 24, out of the four for which he was elected, could run in early presidential and legislative elections, whose positions will last until 2025.

Lasso was prosecuted in the Assembly for a case of alleged embezzlement in a crude oil transportation contract between the state company Ecuadorian Oil Fleet (Flopec) and the private company Amazon Tanker.

The opposition, which dominated the dissolved Assembly, hoped to have more than the 92 votes required to censure the ruler, in a vote that was due to take place this Saturday.

To apply the “cross death”, Lasso argued a “serious political crisis and internal commotion”, which the opposition has said does not exist, which is why some legislators filed demands with the Constitutional Court, a body that also approved the impeachment trial against the president.
