Milei seeks to reinforce control of marches and effective arrest for those who block the streets

The bill that the president of Argentina, Javier Milei, sent to Congress, incorporates new controls on street demonstrations into the Penal Code and increases penalties through cuts. So much so that anyone who “prevents, impedes or hampers the normal functioning” of transport is punished with up to three and a half years in prison; In other words, if this reform is approved, picketing could be punished with effective imprisonment. Today, the maximum for this crime is two years.

What is more, especially sanctions the organizers of the cuts and holds them jointly and severally responsible for any damage that may occur to things, even to organizers who were not present at the demonstration.

A key point of the new wording that Milei proposes for the Penal Code is that it establishes the obligation to notify “in a reliable manner before the Ministry of National Security” of any “meeting or demonstration”.

The initiative says that the ministry may “oppose the holding of the meeting or demonstration based on issues that concern the safety of people or national security”. In addition, “you may propose changes to the time, place or completion date”. It does not establish what happens if the protesters ignore this “proposal” from the Government.

Even “spontaneous manifestations” must be reported -says the bill- “as far in advance as possible” to the Ministry of Security, currently in charge of Patricia Bullrich.
