Bolivian Prosecutor’s Office presents a formal accusation against Jeanine Áñez

The general secretary of the State Attorney Edwin Quispe, explained that the prosecutors commission after carrying out the “investigation” and the “analysis” From the testimonial and documentary evidences, he concluded that there are sufficient elements for the accusation.

He added that the Public Ministry presented at least 70 evidence and that now with this formal accusation the preliminary stage of the investigation is concluded and now the corresponding oral trial will be held.

“Coup I and II cases have to do with the actions attributed to Mrs. Jeanine Áñez before she was proclaimed President of the State”, Quispe emphasized.

Áñez is being held in preventive detention in a prison in La Paz for the “coup d’état I” case in which she is accused of sedition, conspiracy and terrorism due to the political and social crisis that Bolivia experienced in 2019 after the failed elections.

In July the case was divided into two, expanding the charges for breaches of duties and resolutions against the Constitution due to the way in which he acceded to the Presidency after the resignation of Evo Morales, denouncing an alleged “coup” against him.

Initially, the temporary ex-president had to serve her preventive detention for four months, which was extended to six and then it was extended to another six months due to the case of “coup d’état II”.

In the “coup d’état II” case, Áñez, the former commander of the Armed Forces William Kaliman, the former commander of the Police Yuri Calderón, the former commander of the Bolivian Air Force Jorge Terceros, among others, are accused.

THE DEFENSE OF ÁÑEZ

Áñez’s defense stated that the accusation against the transitory ex-president is “totally vague and abstract” and that several technical ocular inspections have not been carried out, and that the statements of other investigated were not taken.

In addition, the defense requested several reports from the Senate, the Armed Forces, the National Police, the Constitutional Court, the Supreme Electoral Tribunal, the Ombudsman’s Office, among others, lawyer Norka Cuéllar commented at a press conference.

Cuéllar argued that Áñez’s statements from June cannot be used for another case when the “coup d’état II” case began in July.

For his part, attorney Luis Guillén indicated that there must be “sufficient evidence” to support the accusation “and that they cannot be resolved in an ordinary court.

“This task cannot be carried out by an ordinary court, we are going to create legal chaos because it is a task in accordance with the Political Constitution of the State, it corresponds to a Constitutional Court,” said Guillén.

He also mentioned that the Public Ministry did not carry out the “investigative acts” despite the fact that Áñez was in preventive detention and that now that there is an accusation, it is appropriate for the release order to be issued ex officio.

In the same way, in Áñez’s social networks they indicated that the objective is to “condemn her at any price” and that “they do not care about the independence of the Judicial Branch.”

“Jeanine Áñez is the scapegoat of a totalitarian project against Bolivia, freedom and unity,” says the message on Áñez’s networks.

The ex-president also faces another process in the ordinary way for an alleged irregular appointment of an official in a state entity during her administration, in addition the Bolivian Parliament analyzes several liability lawsuits against Áñez.
