A woman is sentenced to 30 years in prison in El Salvador for a “miscarriage”

Seven years ago there was no similar conviction.

The decision was criticized on Tuesday by feminist organizations, who argued that the Salvadoran state criminalizes women’s public health problems.

What happened to Esme?

According to the Citizen Group for the Decriminalization of Abortion, Esme was 28 years old when she lost her baby.

The woman was alone in her home in a rural area when gave birth in October 2019.

The baby died, while she was rushed to hospital with a tear and hemorrhage.

Following the incident, Esme was charged and placed in pre-trial detention.

The organization Agrupación Ciudadana has said that since then was removed of a seven-year-old daughter.

The woman’s lawyer, quoted by the Efe agency, commented that the judge “acted with partiality, favoring the version offered by the Attorney General’s Office, which was loaded with stigmas and gender stereotypes, for which it is going to appeal the decision”.

Anti-abortion laws in El Salvador

El Salvador has strict anti-abortion laws. It is prohibited even in cases of rape or inviability outside the womb.

Women who abort face sentences of between two to eight years in prison that can increase to 40 years if they are found guilty of aggravated homicide.

Citizen Group denounced that in the last 20 years some 181 women have been imprisoned for having an abortion in the midst of obstetric emergencies.

Morera recalled on Tuesday that the Inter-American Court of Human Rights issued a resolution asking El Salvador to decriminalize such health situations.

However, some 64 women have been released to date. In 2019 alone, three were released from prison with 30-year sentences.
