Apple wants to take over the apple: it requests to patent the image of the fruit as a brand

“According to the Swiss, Apple not only wants to challenge its logo, but also to obtain the intellectual property rights of all pictorial representations of apples.”, reports Gizmodo.

In 2017, the Cupertino giant applied to the Swiss Institute of Intellectual Property for the rights to the realistic black and white representation of the apple known as Granny Smith. This application covered different potential uses such as hardware, electronic, digital and audiovisual products.

After the debate, the Institute granted the rights to only some of the categories that Apple demanded, stressing that the apple is in the public domain according to a legal principle.

Not satisfied, Apple appealed to obtain all rights.

For his part, Jimmy Mariéthoz, the director of Fruit Union Suisse, said in a conversation with Wired that they are concerned because they do not know very well what are the uses that Apple would try to protect and, above all, because the company has a history of aggressively pursuing infringements of its trademarks.

“Their goal is to own the rights to a real apple, something almost universal that should be free for everyone to use.“, he claimed.

Concern also points out that Fruit Union Suisse, who have used an apple as their logo for a long time, would have to stop using it.

“Theoretically, we could be entering slippery territory every time we advertise with an apple.”, he expressed.

At the moment, the final decision of the Swiss Institute must be awaited and this can take months or years. But from now on, Apple is expected to battle.

“Apple didn’t invent apples… We’ve been around for 111 years. And I think apples have been around for a few thousand more.” warned Mariethoz.
